Florida seeks court order barring OpenAI from developing new models

Attorney General James Uthmeier also wants the court to keep minors off ChatGPT and prohibit the platform from being given “human attributes”.

Florida Attorney General James Uthmeier asked a judge on 28 September for an emergency injunction that would bar OpenAI from developing new AI models without outside oversight, Reuters reported.

The request forms part of a lawsuit Florida brought against OpenAI in June. The state accuses the company of misrepresenting the safety of ChatGPT. The alleged harms involve ChatGPT giving perpetrators of school shootings material, counselling children about self-injury, plus fostering addiction among minors.

Uthmeier also asked the court to require OpenAI to keep minors off ChatGPT and to prohibit the company from giving its chat platform “human attributes”. His requested restrictions would reach both the development of new models and access to the existing platform.

Uthmeier claims OpenAI cannot properly regulate its own technology, Axios reported, describing the dispute as a potential test of how far states can restrict AI companies when the federal government has declined to enact guardrails.

An OpenAI spokesperson did not immediately respond to a request for comment, Reuters reported.
